Terms and Conditions
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Nepalese Events Australia ("Platform", "we", "us") governing your access to and use of our website, mobile application, and all associated services. By creating an account, browsing events, purchasing tickets, listing events, or using any Platform feature, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Definitions
- "Platform" — The Nepalese Events Australia website, mobile application, and all associated services
- "User" — Any individual who accesses or uses the Platform, including both attendees and organisers
- "Organiser" / "Vendor" — A User who creates, lists, manages, or sells tickets for events on the Platform
- "Attendee" — A User who purchases tickets or registers for events through the Platform
- "Event" — Any gathering listed on the Platform, including concerts, festivals, community events, workshops, and sports
- "Ticket" — A digital pass (with QR code) granting entry to an Event, purchased through the Platform
2. Acceptance of Terms
By using the Platform, you confirm that:
- You are at least 16 years old (minors must have parent/guardian consent for ticket purchases)
- You have the legal capacity to enter into binding agreements under Australian law
- You agree to these Terms and our Privacy Policy
- If you do not agree, you must not access or use the Platform
3. Account Registration & Security
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your login credentials
- You are liable for all activities that occur under your account, whether authorised or not
- Email addresses cannot be changed after registration without contacting support — this is a security measure
- You must not create multiple accounts or share account credentials with others
- Notify us immediately of any unauthorised account access or security breach
- We may suspend or terminate accounts that violate these Terms or engage in fraudulent activity
4. Ticket Purchases
4.1 Booking Process
- All ticket sales are processed through Stripe, a PCI-DSS compliant payment gateway
- Ticket prices are set by event organisers. Nepalese Events Australia charges a service fee and/or commission on each sale, displayed transparently at checkout
- Once payment is confirmed, tickets are issued immediately via email and made available in your My Tickets dashboard
4.2 Ticket Validity & Use
- Tickets are personal to the named attendee and are non-transferable except through our official ticket transfer feature
- Each ticket has a unique QR code. Duplicate, copied, or fraudulent tickets will be rejected at entry
- Attendees must present a valid ticket (digital or printed) at the event for entry
- Nepalese Events Australia is not responsible for denied entry due to invalid, duplicated, or fraudulent tickets
- Reselling tickets above face value is prohibited and may result in account suspension
4.3 Refunds
Ticket refunds are governed by our Refund Policy and the Australian Consumer Law. Key points:
- Full refunds are provided for cancelled events
- Change-of-mind refunds are not available — use the ticket transfer feature instead
- Duplicate charges due to technical errors will be refunded upon verification
5. Event Organisers & Vendors
5.1 Organiser Responsibilities
- Provide accurate, complete, and current event information (date, time, venue, pricing, descriptions, images)
- Obtain all necessary permits, licences, insurance, and approvals required to hold the event
- Comply with all applicable Australian laws, including consumer protection, safety, anti-discrimination, and venue regulations
- Deliver the event as described. Significant changes must be communicated to ticket holders promptly via the Platform
- Respond to attendee inquiries within a reasonable timeframe (recommended: 48 hours)
- Ensure the venue meets safety standards and has adequate capacity for ticket sales
5.2 Commission & Fees
- Nepalese Events Australia charges a 10% commission on each paid ticket sale, unless otherwise agreed in writing
- Listing events is free. Free events (no ticket cost) incur zero fees
- Payment processing fees (Stripe) are passed through at cost
- Commission is deducted from earnings before payout
- Full terms are in our Vendor Agreement
5.3 Payouts
- Earnings are available for withdrawal after the event concludes and the refund window passes
- Minimum withdrawal: $50 AUD to an Australian bank account
- Withdrawals processed within 5 business days
- Vendors are responsible for their own tax obligations (GST, income tax)
5.4 Prohibited Activities
- Listing fake, fraudulent, or non-existent events
- Selling tickets above the maximum permitted price
- Using the Platform for money laundering or illegal activities
- Harvesting attendee contact information for purposes outside event communication
- Creating duplicate listings for the same event
- Misrepresenting event details, capacity, or venue
6. Community Features & Code of Conduct
Our Platform includes event chat, community forums, and user-generated content features. By using these features, you agree to our Code of Conduct:
- Be respectful and inclusive — no harassment, hate speech, or discrimination
- Do not post spam, advertising, or promotional content without authorisation
- Do not share personal information of others without consent
- Do not impersonate other users or organisations
- Do not post content that is illegal, offensive, or harmful
- Violations may result in content removal, chat suspension, or account termination
7. Intellectual Property
7.1 Platform Content
All Platform content — including logos, designs, text, graphics, software, and user interface — is the property of Nepalese Events Australia or its licensors and is protected by Australian and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.
7.2 User-Generated Content
- Event listings, images, and descriptions remain the property of the respective organisers
- By submitting content, you grant Nepalese Events Australia a non-exclusive, royalty-free licence to display, reproduce, and promote your content on the Platform and in marketing materials
- You warrant that your content does not infringe any third-party intellectual property rights
8. Limitation of Liability
To the fullest extent permitted by Australian law:
- Nepalese Events Australia acts as a platform connecting organisers and attendees. We are not the provider of the events themselves
- We are not liable for the actions, omissions, conduct, or quality of any event organiser or other user
- We are not liable for event cancellation, postponement, venue changes, or failure to deliver events as described
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
- Our total aggregate liability for any claim arising from these Terms is limited to the amount you paid us in the 12 months preceding the claim
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you have under the Australian Consumer Law that cannot be excluded.
9. Indemnity
You agree to indemnify and hold harmless Nepalese Events Australia, its directors, employees, contractors, and partners from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:
- Your use of the Platform or violation of these Terms
- Your infringement of any third-party intellectual property or other rights
- Any content you submit to the Platform
- Any event you organise, including claims by attendees
10. Termination
- We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct harmful to the Platform or its users
- You may close your account at any time by contacting support
- Upon termination, your right to use the Platform ceases immediately
- Provisions that by their nature should survive termination (including intellectual property, indemnity, and limitation of liability) shall remain in effect
11. Dispute Resolution
- Both parties agree to attempt to resolve disputes informally first, by contacting the other party
- If informal resolution fails, disputes will be resolved through mediation in Sydney, NSW
- If mediation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia
12. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms at any time. Significant changes will be communicated via email or a prominent notice on the Platform. The "Last updated" date below indicates when the Terms were last revised. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
