Vendor (Event Organiser) Agreement

This Vendor Agreement ("Agreement") is a legally binding contract between you ("Vendor", "Organiser") and Nepalese Events Australia ("Platform", "we", "us"). By creating events, selling tickets, or using vendor features, you agree to this Agreement.
1. Vendor Responsibilities
- Provide accurate, complete, and up-to-date event information including date, time, venue, pricing, and description.
- Obtain all necessary permits, licences, and approvals required to hold the event.
- Comply with all applicable Australian laws, including consumer protection, safety, and anti-discrimination laws.
- Deliver the event as described in the listing. Significant changes must be communicated to ticket holders promptly.
- Respond to attendee inquiries within a reasonable timeframe.
- Ensure the venue meets safety standards and has adequate capacity for ticket sales.
2. Commission and Fees
- Nepalese Events Australia charges a commission on each ticket sale, as specified in your vendor account settings.
- The default commission rate is 10% of the ticket price, unless otherwise agreed in writing.
- Commission is deducted from your earnings before payout.
- Payment processing fees (Stripe) are passed through at cost.
- Earnings are available for withdrawal once the event has concluded and any refund window has passed.
3. Payouts and Withdrawals
- Vendors can request withdrawals to their registered Australian bank account or PayPal.
- Minimum withdrawal amount is $50 AUD.
- Withdrawals are processed within 5 business days.
- Vendors are responsible for their own tax obligations, including GST and income tax.
4. Refunds and Chargebacks
- Vendors agree to honour refunds as outlined in our Refund Policy.
- If an event is cancelled, the vendor authorises Nepalese Events Australia to refund ticket holders from the vendor's earnings balance.
- Chargebacks disputed by attendees will be investigated. If resolved in the attendee's favour, the amount will be deducted from the vendor's earnings.
5. Prohibited Activities
- Listing fake, fraudulent, or non-existent events.
- Selling tickets above the maximum price permitted by law or venue policy.
- Using the Platform to launder money or engage in illegal activities.
- Harvesting attendee contact information for purposes outside of event communication.
- Creating duplicate listings for the same event.
6. Account Suspension
We reserve the right to suspend or terminate vendor accounts that violate this Agreement, receive excessive refund requests or complaints, or engage in fraudulent activity. Suspended accounts will have pending earnings held pending investigation.
7. Content Ownership
Vendors retain ownership of event content (images, descriptions, branding). By listing an event, you grant Nepalese Events Australia a non-exclusive licence to display and promote your event on our Platform and marketing channels.
8. Liability
The vendor is solely responsible for the event and any claims arising from it. Nepalese Events Australia is not liable for event-related incidents, injuries, or losses. Vendors should obtain appropriate public liability insurance.
9. Changes to This Agreement
We may update this Agreement with 30 days notice. Continued use of vendor features after changes constitutes acceptance.
